Spanish Authorities Review Apple and Amazon Over Competition Rule Violations

Spanish competition authorities have issued a new ruling concerning Apple and Amazon over delays in removing contract clauses deemed anti-competitive in Amazon Spain’s distribution agreements, according to Reuters.

The Spanish Competition Authority had previously fined the two companies a total of €194 million in July 2023 and ordered the immediate removal of the clauses, which limited the number of sellers allowed to distribute Apple products on Amazon Spain, restricted the promotion of competing products, and hindered marketing campaigns for such products.

Investigations revealed that Apple and Amazon’s delayed compliance resulted in continued violation until May 2025. Consequently, authorities are considering an additional fine for non-compliance.

Both companies have responded by challenging the new ruling. Apple stated that it respects the authority but disagrees with the decision, emphasizing its commitment to protecting customers from counterfeit products and ensuring genuine items. Amazon also announced plans to appeal, noting that its business model depends on the success of third-party sellers, including small and medium enterprises, and that it does not benefit from excluding sellers.

The final decision on any additional fine will be subject to the Spanish Supreme Court, which had previously suspended the enforcement of the original €194 million fine pending the appeal outcome.

This action reflects ongoing European efforts to enforce fair competition in e-commerce markets and prevent undue control over distribution channels, amid growing global scrutiny of major technology companies.
